This paper considers law’s engagement with pregnancy/workplace conflicts. Drawing on recent research, including original empirical research conducted by the author, I consider how law’s response is ineffective. The nature of this ‘ineffective response’ is explored and in particular I consider the gap between, on the one hand, legal prescriptions and policy ambitions and, on the other hand, the reality of pregnancy/workplace conflicts. In essence, law fails to capture the experiences of pregnant women and new mothers at work and this is (...) reflected in the high number of women experiencing pregnancy discrimination, the low number of women invoking the law in order to gain redress when they do experience pregnancy/workplace conflicts and the low success rate amongst the few women that do bring claims against employers in such circumstances. Il n’y a généralement pas de « faits » qui conduisent à une politique correcte unique. Les éléments de preuve qui sont intégrés dans les avis scientifiques destinés à une décision politique nécessitent une évaluation de leur qualité. En 2003, l’Agence néerlandaise d’évaluation environnementale a adopté une méthode standardisée, désignée sous le nom de « guide », dans le cadre de laquelle les principaux aspects de (...) la production et de l’utilisation des connaissances sont présentés grâce à une liste de contrôle visant à l’évaluation et à la communication des incertitudes. Dans cet article, nous présentons des résultats de l’application de ce guide à la controverse sur les risques des particules en suspension. La délibération active sur l’incertitude dans un contexte d’expertise entraîne un processus d’apprentissage commun entre les experts et les décideurs politiques, ce qui conduit à une meilleure prise de conscience du phénomène d’incertitude et de ses implications politiques.Policy decisions on complex environmental risks often involve disputed science. Typically, there are no “ facts” to support a single unequivocally correct policy. The evidence provided in scientific studies for policy-making decisions requires high-quality assessment. In 2003, the Netherlands Environmental Assessment Agency adopted a standardized method, referred to as “guidelines”, whereby key quality aspects of knowledge production and use are presented in the form of a checklist for uncertainty assessments and communication. In this article, we present the outcomes of applying the guidelines in controversies on the risks of ambient particulate matter. In the policy–advisory context, active deliberation on uncertainty produces a common learning process for advisors and policy makers, which leads to a deeper understanding and increased awareness of the phenomenon of uncertainty and its policy implications. I propose a programme of research in ethical philosophy, into the peak-experiences or wow-moments that I, following James Joyce and others, call epiphanies. As a first pass, I characterize an epiphany as an (1) overwhelming (2) existentially significant manifestation of (3) value, (4) often sudden and surprising, (5) which feels like it “comes from outside” – it is something given, relative to which I am a passive perceiver – which (6) teaches us something new, which (7) “takes us out (...) of ourselves”, and which (8) demands a response. Often the correct response is love, often it is pity, or again creativity. It might also be anger or reverence or awe or a hunger to put things right – a hunger for justice; or many other things. It may be something that leads directly to action, but it may also be something that prompts contemplation; or other responses again. Since epiphanies are what I call a focal-case category, not all of the conditions listed above have to be fulfilled by all instances of epiphanies. In order to allow the reader to get a better grip on which range of phenomena may count as an epiphany, I examine in some detail several examples from literature, in particular from works by Murdoch, Hopkins, Wordsworth, C.S. Several years in the making, the volume was edited by Patrick Henry, director of the Institute for Ecumenical and Cultural Research at St. John's Abbey in Collegeville, Minnesota. (...) It contains the reflections of four Buddhist authors—Norman Fischer, Joseph Goldstein, Judith Simmer-Brown, and Yifa—on selected parts of the Rule of Saint Benedict and has already met with such success that plans are underway to have it translated into several foreign languages.To coincide with the publication of the book, the Monastic Interreligious Dialogue (MID) board decided to hold a conference at Our Lady of Grace Monastery in Beech Grove, Indiana, from September 21-23, 2001. Originally all four of the Buddhist authors had intended to come, but in light of the terrorist attacks of September 11, Norman Fischer and Joseph Goldstein felt it was more important that they remain with their own communities during those days. However, Judith Simmer-Brown and Yifa did attend, along with more than a hundred other persons. The attendees included Father Patrick Barry, the former abbot of Ampleforth Abbey in England, who is currently residing at St. Louis Abbey in Missouri. His sensitive translation of the Rule of Saint Benedict is included as an appendix to Benedict's Dharma.On the opening evening, Father William Skudlarek, OSB, the chair of the MID board, extended a warm welcome to those attending and then introduced Patrick Henry, who served as moderator of the entire conference. Brother David Steindl-Rast, OSB, who had worked closely on the project from its inception and had written an afterword to the book, spoke on the Rule of Benedict as a "trellis," which is the root meaning of the Latin and Greek words translated as "rule." Just as a trellis in a garden provides a structure for the plant climbing on it, so does the Rule of Saint Benedict establish a framework on which a life can grow. Brother David's talk was followed by the assigning of "dyads," groups of two participants each; the pairs would use allotted times during the conference for dialogue about matters raised in the general sessions.The next day, Saturday, September 22, began with sitting meditation in the monastery chapel, followed by the service of Morning Praise with the resident community of Benedictine sisters. Various other activities were in the conference schedule, [End Page 199] but especially prominent were talks given by Christian monastics as their responses to the book out of their own experience of living according to the Benedictine Rule. The first of these talks was given by Sister Sarah Schwartzberg of the Benedictine Sisters of Perpetual Adoration. Her assigned topic was the section of the book Benedict's Dharma dealing with the themes of "freedom and forgiveness." Following a late-morning Eucharist and lunch, two presentations were made in the afternoon: Abbot Francis Cline, OCSO, of Mepkin Abbey in South Carolina, reflected on "discipline and spontaneity," and Father Columba Stewart, OSB, of Saint John's Abbey, Collegeville, Minnesota, spoke on the part of the book focusing on "tradition and adaptation." Those attending the conference again joined the resident community for vespers in the monastery chapel and then, after dinner, heard Father James Wiseman, OSB, of Saint Anselm's Abbey in Washington, D.C., speak on the themes of "leadership and humility" as these had been treated by the Buddhist authors in the last section of the book.The Sunday schedule began in a way similar to that of Saturday, with morning talks by the Buddhist scholar the Venerable Heng Sure and the MID chair Father Skudlarek. After Eucharist, Judith Simmer-Brown made some extemporaneous closing remarks to thank persons who had worked so hard to make the entire project a success. Back and forth swings the pendulum. It is remarkable that Baars can claim that “many scientists now feel that radical behaviorists tossed out the baby with the bathwater” while not being able to see that his own efforts threaten to be an instance of the complementary overshooting–what we might call covering a nice clean baby with dualistic dirt . Yes indeed, radical behaviorism of Skinner’s variety fell from grace some years ago, with the so-called cognitive revolution, to be replaced (...) by a sort of cognitivistic behaviorism that has plenty of room for inner processes, for talking to yourself, for mental imagery, for hunches, feelings, pains, dreams, beliefs and hopes and expectations, but only so long as these are understood to be physical (“informational” or “computational”) processes that could be accomplished by the machinery of the brain. It is an interesting speculative question whether William James would have been a wholehearted cognitivist, or whether he would have insisted that what he meant by the stream of consciousness had to be sharply distinguished from the streams of mere information-manipulation discernible in the activities of cortical subsystems, etc., etc. Making a home for consciousness in the brain, for a distinction between unconscious information-transformations and conscious ones, for instance, is now the work of many hands in many fields (See, e.g., Dennett, 2001, and the other essays in the special issue of Cognition devoted to the cognitive neuroscience of consciousness). The main methodological principle of this research is one shared with the radical behaviorists: only intersubjectively accessible data are to be admitted in this natural science of consciousness. If that allegiance, by itself , counts as ‘behaviorism,” then we should all be behaviorists, and indeed the very researchers Baars cites (Singer, Ericsson and Simon, Hilgard, Crick, and Edelman) scrupulously and unapologetically are behaviorists in this minimal sense. In this two-part essay, we distinguish several senses in which general relativity has been regarded as “locally special relativistic.” Here, in Part 1, we focus on senses in which a relativistic spacetime has been said to be “locally (approximately) Minkowskian.” After critiquing several proposals in the literature, we present a result capturing a substantive sense in which every relativistic spacetime is locally approximately Minkowskian. We then show that Minkowski spacetime is not distinguished in this result: every relativistic spacetime is locally (...) approximately every other spacetime in the same sense. This article analyzes the angular spacing of the degree marks on the zodiac scale of the Antikythera mechanism and demonstrates that over the entire preserved 88° of the zodiac, the marks are systematically placed too close together to be consistent with a uniform distribution over 360°. Thus, in some other part of the zodiac scale (not preserved), the degree marks have been spaced farther apart. By contrast, the day marks on the Egyptian calendar scale are spaced uniformly, apart from minor (...) errors. A solar equation of center is apparent which rises by nearly 2.7° over the preserved portion of the zodiac. The placement of the degree marks indicates that, in the preserved portion of the zodiac, the Sun was considered to run at a uniform pace of about 30° per synodic month, which is consistent with the Sun’s speed in the fast zone of the Babylonian solar theory of System A. In this two-part essay, we distinguish several senses in which general relativity has been regarded as “locally special relativistic.” In Part 1, we focused on senses in which a relativistic spacetime may be said to be “locally (approximately) Minkowskian.” Here, in Part 2, we consider what it might mean to say that a matter theory is “locally special relativistic.” We isolate and evaluate three criteria in the literature and show that they are incompatible: matter theories satisfying one will generally violate (...) others. During the 1970s and 1980s, political psychologists at the State University of New York at Stony Brook focused political scientists’ attention on online processing. Borrowing from the new field of social cognition in psychology, they argued that voters’ evaluations of candidates are the products of a summing up of reactions to happenings during a campaign. Voters might not remember the specific events later on, but their running tallies of reactions over the duration of the campaign would ensure that they take (...) the forgotten information into account when entering the voting booth. Later, these same scholars yet again borrowed from (a very changed) psychology, and argued that many people, especially the most politically sophisticated, try to confirm their current political evaluations—for example, by seeking out confirmatory evidence and dismissing evidence that challenges their attitudes. We ask whether online processing and motivated reasoning have the same or different implications for democratic governance, and whether the two empirical perspectives can be reconciled. (shrink)

Izard (2010) did not seek a descriptive definition of emotion—one that describes the concept as it is used by ordinary folk. Instead, he surveyed scientists’ prescriptive definitions—ones that prescribe how the concept should be used in theories of emotion. That survey showed a lack of agreement today and thus raised doubts about emotion as a useful scientific concept.

Luce Irigaray has written that “sexual difference is one of the major philosophical issues, if not the issue, of our age.” Spanning metaphysics, phenomenology, and psychoanalysis, her work examines how sexual difference structures being and subjectivity, organizes our experience of the world, and affects the images and discourses involved in knowledge production and practical action. No other philosopher has paid such careful attention to the consequences of the elision of sexual difference in philosophical thought. However, at a time when notions (...) of sexual and gender difference are hotly contested, Irigaray’s thought has often been dismissed as essentialist or reductively binary. This book brings together leading scholars to consider the philosophical implications of Irigaray’s writing on sexual difference, particularly for issues of gender and race. Their essays directly confront the charge of essentialism, exploring how Irigaray’s thought opens new possibilities for understanding the complexity of gender identities, including nonbinary and trans experiences as well as alternative configurations of masculinity and femininity. Though Irigaray is sometimes accused of a failure to appreciate racial difference, contributors show the productive role of her work in thinking race. Later, these same scholars yet again borrowed from (a very changed) psychology, and argued that many people, especially the most politically sophisticated, try to confirm their current political evaluations—for example, by seeking out confirmatory evidence and dismissing evidence that challenges their attitudes. Page's proposal to stipulate representations in which individual units correspond to meaningful entities is too unconstrained to support effective theorizing. An approach combining general computational principles with domain-specific assumptions, in which learning is used to discover representations that are effective in solving tasks, provides more insight into why cognitive and neural systems are organized the way they are.

Culture can be defined as “group typical behaviour patterns shared by members of a community that rely on socially learned and transmitted information”. Once thought to be a distinguishing characteristic of humans relative to other animals it is now generally accepted to exist more widely, with especially abundant evidence in non-human primates, cetaceans, and birds. More recently, cumulative cultural evolution has taken on this distinguishing role. CCE, it is argued, allows humans, uniquely, to ratchet up the complexity or efficiency of (...) cultural traits over time. This “ratchet effect” gives the capacity to accumulate beneficial modifications over time beyond the capacities of a single individual. Mesoudi and Thornton define a core set of criteria for identifying CCE in humans and non-human animals that places emphasis on some performance measure of traits increasing over time. They suggest this emphasis is also pertinent to cultural products in the aesthetic domain, but is this the case? Music, art and dance evolve over time, but can we say they gain beneficial modifications that increase their aesthetic value? Here we bring together perspectives from philosophy, musicology and biology to build a conceptual analysis of this question. We summarise current thinking on cumulative culture and aesthetics across fields to determine how aesthetic culture fits into the concept of CCE. We argue that this concept is problematic to reconcile with dominant views of aesthetics in philosophical analysis and struggles to characterise aesthetic cultures that evolve over time. We suggest that a tension arises from fundamental differences between cultural evolution in aesthetic and technological domains. Furthermore, this tension contributes to current debates between reconstructive and preservative theories of cultural evolution. (shrink)

In this paper, we show that a restricted form of time travel both accords with special relativity kinematics and avoids several prima facie objections. We argue that such time travel provides a reasonable way to interpret certain phenomena which can readily be described, and the analogues of which have already been observed at the level of elementary particle reactions. We then describe how a time-traveling object could measure itself, and demonstrate how, in the appropriate circumstances, such an experiment could convince (...) a theorist who insisted on a single criterion for length measurements that his standard had itself changed in length. The same experiment can shed light on the possibility of detecting a universal expansion; and we show that, given certain experimental results, one must conclude that every member of a class of time travelers has changed in length simultaneously, though perhaps only while going backwards in time. Thirty-four states, the District of Columbia, and Puerto Rico have legalized medical cannabis. While no two state medical cannabis programs are alike, public health concerns related to advertising, packaging and labeling, pesticide use, scientific research, and the role of medical cannabis in the opioid crisis are emerging across the country. This article examines these issues, the policy approaches states are adopting to protect patients and the public, and an assessment of the underlying federal legal landscape.

Recently, feminists like Jane Roland-Martin, Elizabeth Young-Bruehl, and others have advocated a conversational metaphor for thinking and rationality, and our image of the rational person. Elizabeth Young-Bruehl refers to thinking as a “constant interconnecting of representations of experiences and an extension of how we hear ourselves and others. There are numerous disadvantages to thinking about thinking as a conversation.We think there are difficulties in accepting the current formulation of the conversational metaphor without question. First, there is danger that we will (...) lose important dialectical connections like that between the self and society. Second, the conversational metaphor alone cannot fully express the way conversations are constructed. We will want to take up the notion of narrative as a metaphor for thinking advocated by Susan Bordo, Alasdair MacIntyre, Jerome Bruner, and others, including Mary Belenky and her colleagues.Eventually, we want to champion narrative and the dramatic narrative of culture as a metaphor for thinking that involves such expressions as sights, insights, silences, as well as sounds, moments of mood and poetic moments. The dramatic narrative provides the structural possibilities needed to criticize certain kinds of conversations, in order to talk about the relations of public and private, self and society and most importantly, about the drama of our lives within and without.The dramatic narrative for thinking helps dispel the dangerous dualisms of mind and body that not even conversation or narration alone can banish, and allows us to frame questions about education that do not require us to separate mind from body. The dramatic narrative metaphor for thinking lets us show who we are, act out what we think, and reconstruct rationality to reflect what many women, and some men, do. (shrink)
